The applying rules of court decision may change with the effect of China Civil Code

Civil Code of People’s Republic of China was released on June 1st 2020, and took effect from Jan.1st 2021.
The Civil Code integrated and modified many of the past laws of civil nature, among which are:
The General Provisions of Civil Law of PRC;
Property Law of PRC;
Tort Law of PRC;
Contract Law of PRC;
Guarantee Law of PRC;
Marriage Law of PRC;
Inheritance Law of PRC;
Adoption Law of PRC;
The Civil Code took effect.
Along with it, China Supreme Court modified the relevant judicial interpretation which was used to instruct the local court in processing cases. In the last month of 2020, the Supreme Court release a series of judicial interpretations, among them are:
The Supreme Court’s interpretation of legal issues regarding the trial of employment disputes;
The Supreme Court’s interpretation of legal issues regarding the trail of construction disputes;
The Supreme Court’s first interpretation regarding the property part of PRC Civil Code;
The Supreme Court’s first interpretation regarding the inheritance part of PRC Civil Code;
The Supreme Court’s first interpretation regarding the marriage and family part of PRC Civil Code;
The Supreme Court’s regulation regarding the time effect for applying for PRC Civil Code;
The Supreme Court’s interpretation regarding the guarantee rules of PRC Civil Code;
And more;
After PRC Civil Code took effect, most of previous law would be modified to be insistent with it. Even though the Supreme Court has modified many of its judicial interpretations, there also exist many rules made by higher level court and regulations of government, which may be have some difference, in somewhat degree, with the civil code.
Foreigners working or investing in China should consult a legal professional when making decisions to avoid depending on laws that have lost its effect.
